The Federal Government Is About to Regulate Your E-Bike Battery. Here’s What Changes.

For the entire history of the industry, e-bike battery safety standards have been voluntary. A rule proposed in June would make them mandatory — and it goes further than the standards it’s built on.

If you own an e-bike, are thinking about buying one, or just live in a building where somebody charges one in the hallway, this is the regulatory shift that matters.

On June 24, 2026, the Consumer Product Safety Commission published a Notice of Proposed Rulemaking that would create a new federal safety standard — 16 CFR Part 1265 — covering lithium-ion batteries and electrical systems in e-bikes and other micromobility products. It is a proposal, not a final rule. But it’s the furthest the federal government has gone, and it would reshape what’s legal to sell in the United States.

What the proposal actually does

The rule builds on three existing UL standards and makes them mandatory rather than voluntary:

  • UL 2849 — electrical systems for complete e-bikes
  • UL 2271 — separately sold, user-replaceable battery packs
  • UL 2272 — electrical systems for personal e-mobility devices like scooters and hoverboards

Here’s the part manufacturers are paying attention to: the CPSC isn’t simply adopting those standards. It’s incorporating them with modifications, adding requirements on top. The proposal includes tamper-resistant battery enclosures, additional battery charging and reverse-polarity testing, and expanded warnings and consumer instructions.

The practical consequence is that a product already certified to the current version of UL 2849 should not be assumed to comply. Products meeting today’s standards would likely need design changes, retesting, or updated labeling to satisfy a final federal rule.

The scope is broad. It covers complete e-bikes, replacement battery packs, battery management systems, chargers, aftermarket electrical components, and conversion kits that turn a regular bicycle into an electric one. That last category matters — conversion kits and no-name replacement packs are where a disproportionate share of the fire risk has been concentrated, and they’ve been almost entirely unregulated.

The stated goal is reducing thermal runaway, the failure mode where a lithium-ion cell overheats uncontrollably and produces fire, explosion, and toxic smoke.

Where it stands, and the timeline

Written comments were due August 24, 2026, filed to docket CPSC-2025-0012. The Commission now reviews those comments and decides whether to issue a final rule.

If it does, the current proposal sets the effective date at 180 days after the final rule publishes in the Federal Register. So the earliest realistic compliance date is well into 2027, and it could slip considerably further. Anyone telling you there’s a federal e-bike battery mandate in force right now is wrong.

One related change is already live: as of July 8, 2026, importers of regulated consumer products must electronically file Certificates of Compliance before goods enter U.S. commerce. That doesn’t create new testing obligations, but it gives CPSC and Customs and Border Protection a mechanism to flag noncompliant products at the border — which is where most of the dangerous inventory has historically entered.

Why now

The push didn’t come from nowhere. CPSC sent a letter to micromobility manufacturers back in December 2022 urging compliance with the relevant UL standards, then held a stakeholder forum in July 2023. In the years since, the agency has identified dozens of deaths and injuries tied to micromobility battery incidents, and has issued “stop use” warnings in cases where companies allegedly failed to cooperate with recalls.

Congress has been circling the same problem. The Setting Consumer Standards for Lithium-Ion Batteries Act, a bipartisan bill, would require CPSC to issue exactly this kind of standard.

And cities got there first, because cities had the fires. New York has been the epicenter, and its response — requiring batteries to meet UL 2271, with no alternative standard accepted — is stricter in that specific respect than what California passed.

If you already own an e-bike

Nothing here is retroactive. A proposed rule governs what can be sold, not what you own.

What it should change is your behavior around charging, because the fire risk was never really about the bike. It was about the pack, the charger, and where the charging happens.

  • Use the charger that came with the bike. Mismatched chargers are a leading cause of failures.
  • Don’t charge while you’re asleep or out of the house. Thermal runaway progresses fast, and the whole point is being present to catch it.
  • Don’t charge in a hallway, doorway, or anywhere that blocks your exit. This is the detail that turns a fire into a fatality.
  • Stop using a pack that swells, smells, gets unusually hot, or has been in a crash. A damaged cell doesn’t heal.
  • Be extremely careful with replacement packs and conversion kits. This is where uncertified product concentrates, and where the proposed federal rule is aimed.

The state patchwork

Federal law defines what a low-speed electric bicycle is as a consumer product — under 750 watts, and no more than 20 mph on motor power alone — but leaves the road rules entirely to states.

Most states have adopted some version of the three-class system, originally developed as model legislation and based on California’s AB 1096:

  • Class 1 — pedal assist only, cuts out at 20 mph
  • Class 2 — throttle, cuts out at 20 mph
  • Class 3 — pedal assist up to 28 mph

If you know your class, you can predict most of what your state expects. Class 1 and Class 2 are treated almost exactly like regular bicycles in most states — no license, no registration, no insurance. Class 3 is where the rules bite: age minimums, usually 16, helmet requirements in many states regardless of age, and restrictions on multi-use paths.

2026 was an unusually active legislative year. California’s SB 1271 took effect January 1, requiring that e-bikes and batteries sold, leased, or distributed in the state be certified to a recognized standard such as UL 2849 or EN 15194, with a clear certification label — plus new rear reflector and taillight requirements. Washington’s SB 6110 drew a sharp line between e-bikes and electric motorcycles, classifying anything capable of exceeding 20 mph on motor power alone as an electric motorcycle requiring a license, registration, and insurance. Hawaii’s Act 259 introduced the three-class system for the first time and raised the youth helmet requirement to under 18. Tennessee barred riders under 16 from Class 3 e-bikes on streets and highways as of July 1. Oregon passed changes that take effect for most purposes in 2026 but whose age and helmet provisions don’t become operative until January 1, 2027 — a timing detail that trips people up.

The pattern across all of it: states are converging on classification, diverging on enforcement, and increasingly willing to reclassify fast throttle bikes as motor vehicles.

The insurance question nobody asks

Two things worth a phone call to your insurer before you need the answer.

First, whether your homeowners or renters policy covers theft and damage to the bike itself. Many policies cap personal property claims in ways that leave a $3,000 e-bike substantially uncovered, and some treat it as a motorized vehicle and exclude it entirely.

Second — and this is the one people don’t think about — whether your policy covers fire damage originating from a lithium-ion battery on your property. Insurers have been watching the same fire statistics the regulators have. Ask the question in writing and keep the answer.

What to watch

Whether CPSC issues a final rule, and when. If it does, federal preemption becomes a live question: under the Consumer Product Safety Act, a federal standard can displace conflicting state and local requirements, which would affect the growing body of city and state battery laws — including New York’s.

For now, buy certified, charge carefully, and check your own state’s rules rather than assuming they match the one next door.
